Agenda Title:

Authorize Mayor & Finance Officer to Sign an Agreement and Release Entered Between Sweeny Building Investments and the City of Rapid City.

Summary:

On February 8th, 2014, a water valves connecting the water service lines from the properties owned by Sweeny Building Investments and Fatter Boys, LLC failed causing water to be released from the pipes. The failures were located under Main Street where the service line connected to the City water main. The owners of the property paid to replace the valves. The landowner’s property insurer paid for damages within the building, but refused to pay for the valve replacement. The property owners came to the April 29th Public Works Committee Meeting and requested that the City pay for the valve replacement. The Committee directed that staff work with the property owners and come back with a recommendation.

Funding Source & Fiscal Impact (if applicable):

Water Enterprise Fund. The total cost of both agreements is $30,000.

Recommendation:

Action: Approve

Notes: If the Council chooses not to approve this settlement agreement it is likely that the property owners will file suit and seek to recover all of their expenses in replacing the valves.
